Human rights commission subpoena Matlosana Mayor

The South African Human Rights Commission (SAHRC) has subpoenaed the Executive Mayor(EM) of the troubled Klerksdorp-based Matlosana Local Municipality to a hearing.

This after allegations related to the non-provision of free paraffin to indigent households in Matlosana in the North West.

The hearing follows a complaint lodged with the Commission on 2 September 2025, in which it is alleged that the municipality halted the supply of free paraffin to qualifying indigent residents after the appointment of Councillor Mahlophe as Executive Mayor.

According to the SAHRC’s North West Provincial Office, the Commission initiated an investigation into the matter and formally wrote to Councillor Mahlophe requesting a response to the allegations.

Despite follow-up correspondence and further attempts to secure engagement, the Commission reportedly did not receive any response within the stipulated timeframes.

The subpoena hearing aims to establish the facts surrounding the complaint and to assess whether the alleged conduct constitutes a breach of constitutional and human rights obligations.

The outcome of the hearing will also assist the Commission in determining whether any remedial action or recommendations are necessary.

The SAHRC said the hearing forms part of its constitutional mandate to promote respect for human rights, protect their development and monitor their observance.

The hearing is scheduled to take place on Monday, 12 January 2026, at 9:00am at the SAHRC’s North West offices, located at 25 Heystek Street in Rustenburg
